Hi,
I'm a Dad to four kids. Two are to a Mum who lives in Auckland and is ok about me seeing my kids and spending time with them.
The other two boys were taken away to Dannevirke by their Mum and she makes it difficult to see them even when I drive all the way from Auckland.
I was paying the 30% rate of child support, but found I couldn't afford to do that and live - let alone having a place where my kids can stay when they see their Dad.
So I did an admin review and it was reviewed by a bloke who seemed reasonable sympathetic and the result was a reduction in my child support payments.
This happened each year for 4 years and then it was reviewed by Margaret J.
I was left stunned like a possum in the headlights of a car. She changed all the numbers and instead of the original 30% has made it so I have to pay 18% for my two kids in Auckland and another 18% for the two in Dannevirke. So I have to pay 36% of my income - before tax is worked out - as child support AND pay the income tax.
I can't afford this so I wont be able to see my kids.
I want to be able to afford to see my kids. I'm pretty sure my kids want to see their Dad. I'm stuffed if I can figure a way to make it work.
I struggle every day with the thought that Margaret J must hate men so bad or that maybe she was acting on orders from IRD.
There is no-one at IRD who seems even a little bit concerned that justice may have been derailed by someone's personal agenda.
I found a group called Parents for Children and their person helped a bit, but he wasn't able to get a good answer from the site manager at Manukau as to why the review had been worked out like that.
I'm not sure what to do next. I can't pay what they ask because that just money doesn't exist.

The child support payment is not mentioned in any funds anywhere, like tax. Just how much of it is contributed to the government's pocket remains a mystery.
Parents paying child support pay tax twice, and child support on top of it.
You can't afford anything else, you might as well live on a benefit.

In the unlikely event that your ex is not on the benefit then every dollar of child support is paid to your ex (you pay on 20th of the month, it is paid on to your ex 7th of the month following). What happens to all that interest? Interesting question.
But, if you pay penalties this goes straight into the consolidated fund. Ever wondered in the past why the child support people are so keen for you to attract penalties? Wonder how big a bonus they got this year for collecting crown revenue?
If your ex is on the DPB, then ALL your payments are simply taken as benefit recovery [read tax].
The child support agency (part ofthe IRD that do child support stuff) cost approx $68 million per annum.
The latest figure I saw had them collect about $370 million that was not paid on to receiving parents. Of this about $160 million was "core debt" and used as benefit recovery.
The DPB bill each year is approx $2.4 BILLION.
Benefit recover as a percentage is about 0.0667% (SIGNIFICANTLY less than 1%). There is no business that would bother for a RoI this low.
We would be better off if the child support agency was closed and the $68 million was added to the benefit bucket and this stupid law was burnt at the stake.

1. Go on the dole, and get shared custody where you are granted time with your sons. Your child support payments will be alot less, plus I'm sure you will receve Govt assistance for child suppport plus,support for Lawyers fee's so Good Luck!!!
Some women are very destructive and ruins it for those who aren't.
A father I know was paying child support direct to the mother who decided she would also make his life miserable and made application to IRD for more child support. He got everything sorted to pay through IRD then she stopped it, then re-applied a few months later, and stopped it again and re-applied a third time all in the year of 2007. Whilst that was going on, he was getting penalties then credits from IRD while the child wasn't getting any money, and the father was then sent rude texts from the mother.
Money that had been paid direct in December, IRD does not take into account, and the father has to pay a second time for the month of December, this time to IRD, which is supposed to go onto the mother. This senario continues today.
The paying parent asked if he could continue to pay child support through them, and was told no, as the applicant can stop it at any time.....I ask why cant the paying parent be an applicant?
I have suggested also to this paying parent to go on the dole as there is no incentive for him to be anything more than someone's whipping boy...and good luck to him also.

The government is buying the vote of low incomes family, not of the ones from the middle class.
I am a single women, university educated with a ‘good’ (?) full time job in sales. I earn $38000.00 per annum and pay $7410.00 in taxes every year. That leaves me with $30590 and I have to work a lot. I have to cover for all my expenses and will not benefit from any of the schemes introduced by the government. I will never be able to buy a house.
If I was a solo mum and had 1 child, I would have (without needing to work in any way or form) $28075.32 per annum after tax (Domestic Purpose Benefit) and a series of extra benefits to ‘help me’. Please note that I would be able to claim DPB for many years. If I am lucky enough, I will be able to obtain some child support from a random presumed ‘father’ (this will be taxes free for me). I say random because some statistics show that in developed countries 10% to 30% -depending on economic background- of the children are not genetically related to their official father.

Just stumbled across this as Ive just been hit by IRD with a crap load of money to pay.
Basically this is what happened:
My woman walked with my baby girl.
I get a call a couple of days later by a person with a holier then thou atitude saying they have calculated all my expenses and now i have to pay the woman who walked out and took baby against my will, a phenominal amount of money each month.
Dont fathers have a say at all?
How did they calculate my expenses? I havent even seen them let alone shown them my expenses.
Looks like its off to the courts.

The truth of the matter is that most if not ALL so called Child Support paid by any Parent goes toward supporting FAILED NZLaw and FAILED NZSocial Policy that is tearing our Families apart, it does NOT support the Children of the payer

You have my total sympathy. I live in Australia and pay to NZ thanks to the "reciprocal agreement". They take my Australian income - convert it into NZ dollars and remove a New Zealand living allowance - end result I pay even more in child support compared to if the child lived in the same country as me.
Some short highlights of this stuffed evil system:-
During one access visit that had cost me thousands to get in the first place, I had my son tell me of the violence in his home so I couldn't in all conscience send him back, after a Hague convention (that send me into bankruptcy - all her costs paid for by the Aussie government - got to love the Hague!) they send him back - end result - later that year his step father was jailed for raping his mother - some happy home that the lying mother portrayed. P.S. thanks to this episode - I'm the evil kidnapping parent and haven't have any contact for over 4 years and will not have any until he's out of her poisoned grasp - if that even happens!
For 2.5 years IRD didn't even tell me I was running up a debt - I got a bill in the mail for $21,000 one day with pay now or face penalties - I had already paid over $6000 direct to the mother but IRD refused to take this off the bill. I was also paying all access costs ($3000 round trip).
I now pay $282 AUD a fortnight, plus $130 AUD in back payments - so much for my sick wife and two sons I support here. My total overdue bill $34,000 - I have a mortgage and don't even have a house?
To contest the matter I have to fight it in NZ - I LIVE IN AUSTRALIA how fair is that - talk about fighting with one hand tied behind your back.
I curse the NZ government and its unfair evil system

You can apply to the Family Court to have child support payments reduced or even waived on the grounds that they are unfair or cause undue hardship. The fact that the payments affect your ability to see your kids should be good grounds.
It sounds like Margret J has incorrectly applied the formula to get 36% payments and you can again apply to the Family Court to have this looked at.
The whole system is a joke, my and ex and I have been talking, none of the money I have paid has been given to her, not a cent.
So where is my money? I rang them to find out, noone can answer my question.
I said I want accountabilty for my money, I can access all payments that they steal off me, why cant they?
No wonder they need security guards in their high rise flash buildings....

I do agree with all the parents out there, I know we love our children and we want to play a very important role in their lives bur our ex makes this impossible.
The child support formula is taxable income minus the living allowance***it should be income minus the tax less the living allowance......who on earth has the use of the tax money when it just does not exists and the child support payment is tax free. HOW ON EARTH IS IS JUSTIFIED
In fact my living allowance is less than the child support assessment for the year
I do agree with the responsibilites of a liable parent, but not the formula.
The child support payment is becomming so lucrative that the custodial parent is building a great barrier to avoid the liable parent to have shared care.
I plea to all liable parent keep giving feedback, if the govt wants to work in the best interest of children rather promote shared care where possible and at leat a break down should be given to liable parent of where the money is being spent
CHILD SUPPORT UNTIL AGE OF 19
The Govt has a legislation that working for families tax credit needs to be oaid until the child reaches 18 because they feel a child is independent by the age of 18

why for child support we have a age limit of 19 does't the govt of today consider that child ren do become financially independent by 18.

Hi ya, child support is a wrought for the new families, while we struggle to do for our kids we have together struggle, now im not apposed to supporting the child, but why not assess how much she earns to and how much a weekly payment that is fair to raise a child and go half right, so it dosnt matter what you earn you are paying half right? isnt that how it should be, not oh he earns lots he can pay lots but dont worry about his other kiddies and wife? also why not take into account the weekend visitation rights, we still have to house, feed etc the child while he is here...dont worry im not an absolute harden moo, i recieve and we pay CS, and i would hate to think that my ex's too wee kids dont get all they should because he pays such huge CS, what i get for my daughter is to much, i dont spend $100 per week on both my two iv got alone let alone one child..thats insane. The system sucks and economies change we are struggling to make ends meet while she sits pretty with hundreds of dollars a month to spend probably on herself..
and while im on the subject, why cant CS be removed before we are taxed at least that would be some relief, once tax and cs is gone out of our wage then we cant survive on that a week with how rent is, then we have to rely on things the govt hate paying like accom supp and WFF then we have to answer to them like criminals, I just think there has to be a fairer way come on Peter Dunne make it fair for the new kids of the family, you keep saying its all about the kids but my kids suffer to, they dont get to do outside activities we cant afford it. What i would like to see happen is that each family is assessed, IE fill out forms yearly to see how financial the paying parent and his family are, at this stage we pay out $70 pw and have two kids of our own as well, thats a huge chunk by the time taxes come out, it would be nice for them to see how it is for us really, if i didnt work then we would be screwed...and my two boys suffer, how is it for the kids when my kids have to take a back seat until another child turns 19?
